Common Consumer Complaints About AFNI Collections

AFNI Collections is known for a common practice among collection agencies known as “re-aging debt”. When a collection agency re-ages a debt, they change the dates that are associated with when the debt occurred and when the debt was charged-off by the original creditor. By re-aging the debt, they hope to extend the statue of limitations on the validity of the debt. One consumer noted that AFNI changed dates on an outstanding account on their credit report when the statute of limitations had expired on a debt. The consumer in question used their rights as outlined in the Federal Debt Collections Practices Act and sent debt validation letters to them, but they didn’t respond with any proof that the member owed the money. At that point, if they couldn’t verify the debt, they would have to stop contacting the consumer to collect.

If this sounds familiar, you should not pay anything to AFNI until you establish a few facts and try a couple of alternatives to paying the full amount that they say you owe. You should have them validate that the debt is yours. They aren’t interested if there is a case of mistaken identity if you are willing to pay. Even if the debt is yours, the statute of limitations may have expired so they have no legal recourse to collect. If you have a reason to believe that the debt is expired and you are contacted by the collection agency about an old account, send them an Expired SOL Notification letter. This will let them know that they are dealing with an informed consumer and that threatening to sue you for the money owed won’t work.

Going to the Extreme

In some extreme cases, people have reported that AFNI Collections has refused to validate a debt. If this happens to you, you have to seek legal recourse through the State Attorney General. That should get their attention. If you have sent a debt verification letter and they continue to contact you about the debt before they respond to the verification request, it is a clear sign they are violating the law and aren’t going to listen unless you bring government authorities into the mix.

Challenging Inaccurate Items Reported

This isn’t unique to AFNI collection agency but we found that they have issues with keeping paperwork in order which can lead to reporting incorrect items to your credit report. When they buy debt from other collection agencies or from an original creditor, there isn’t always a perfect record of all the accurate details about the debt. Clerical errors or an improperly merged database can lead to credit reporting errors to the credit bureaus. When it comes to keeping your credit report timely and accurate, you are your own best (and sometimes only) advocate.

Always Do It in Writing

If you notice that your credit report is inaccurate, send a item verification letter to the credit bureaus and ask them to remove any items that you believe are incomplete or inaccurate. The best way to contact the credit bureaus is by letter. You want to make sure that you clearly indicate the items you believe are inaccurate and type the letter so they know the request isn’t frivolous. Including supporting documentation helps speed your case along. By law, once you contact the bureaus to dispute inaccurate information, the credit bureau should contact you within 30 days of when they start the investigation. If you include the time for mailing I would expect to hear back from them after 45 days from when you originally mail the item verification letter.

Bad Credit Doesn’t Have to be Permanent

I didn’t become a credit expert because I thought it would be a fun hobby. A couple years ago I got into a situation that left my credit score in shambles. My credit report looked like a hit list of every kind of financial problem you could think of.
